If you have paid your employees less than 100% of their contracted pay rate during lockdown or beyond, then I urge you to read and understand the implications of this recent Employment Relations Authority case. Click link.Simply, it finds that employers who did not follow due process, despite Covid-19, will be liable to compensate their employees (current or former) for any underpayment.
I’m in the travel business (outbound tour operator) and looking at domestic pivots etc etc to reorient the business but we’ve had no revenue for 4 months. I’ve told my staff then wage subsidy ends they will be stood down on no pay as the company temporarily hibernates until international travel resumes. With the announcement today that wage subsidy will not be further extended I’m thinking it would be better for my staff for me to end their employment so they can claim the Covid 19 support benefit for people who have lost their jobs. I can then look to rehire them at some point in the future when cash starts to flow again. Under NZ employment law can I do this? I’ve communicated widely with my staff about the dire situation and they are expecting to be stood down. I’m trying to find a better outcome for them. Any advice gratefully received.

We have wage subsidy for a staff member who needed to take
leave, so we gave him as much paid leave as he had. He has now run that leave
out so is on leave without pay for a few weeks, and will then return to work.
Can I use the wage subsidy for this staff member for other staff members, for
whom we also have wage subsidy, so that we can increase their hours. Note we only have a few weeks left on this wage subsidy.
If casual staff are sick and it is not Covid-19 related should they still get the subsidy? Also if full-time staff are sick and it is not Covid-19 related and have no sick leave left do they still get the subsidy? They are saying they have flu like systems but on their medical certificate it does not specify why they are sick. Thanks
I have asked my employer if they can pay me 2 days of my leave per week as they are only paying me the wage subsidy and I have over 550 hours accrued. He has declined… do I have any rights to get my leave entitlement other than resigning?
I am currently tangled in an unfortunate and exhaustingsituation where I cannot access wage subsidy and have been misled by Winz onwhat to do about it, my employer is negating anything to do with it and I amunsure what to do as I’m suffering pretty major losses now.A brief timeline and description of events is as follows..Employed and working through Extrastaff, sub-contracted to Frank MillerElectrical from: 13/11/2019 – 19/12/2019 – 5 weeks13/1/2020 -23/3/2020 – 10 weeks On 23/3/20 I was told with half a days notice today is the lastday I will be working with Frank Miller.On 23/24 asked for holiday pay in email so i had money over thelockdown because it seemed like things were getting crazy and I wanted tofinancially secure myself (you will soon see the irony).On 24/3 Received response from Extrastaff saying “yep, sorted it”.Sent email inquiring about Wage subsidy to Extrastaff on May 1st – No response Sentagain May 8th – Reply “Lookinginto it”Sent again May 18th -Said I am struggling andreceived response in 10 minutes saying “Hey manWe applied for our guys who were working for us. Youresigned so we didn’t end up applying for youI would say go back to MSD and ask them for it to see ifyou can get it through them.Sorry I can’t be of more help”.This meant that the agency “Extrastaff” unregistered me as anemployee of theirs and so could not claim wage subsidy for me. They have takenmonths to reply to me with anything solid and only a few days ago told me thatthey could not get the wage subsidy for me. When i went in and spoke to themabout it on 20/5/20 they made it clear they cannot claim wage subsidy forspecific people after the fact.On 25/3/20 I had applied for Jobseeker support and was contacted by Winz overthe phone about it. I was told that I should not continue the process andshould follow up wage subsidy as the woman was sure I was eligible when Iexplained my circumstance and that it was put in place for people like me, shechecked with other people in her room that deal with wage subsidy stuff so Ihave taken her word for it and have pursued the wage subsidy up until now. When I called up Winz on 20/5/20 still trying to follow up onthe wage subsidy I was told that they now can’t guarantee I will be back paidover the lockdown period, and that I should apply for Jobseekers supportagain…. Talk about been kicked while your down, I continued trying to get wagesubsidy for this whole time off of their advice and now I am told I may not getback paid. Pretty stressful.Over the lockdown I received an email from Extrastaff addressed by name onApril 3 about Alert Level 4, Pay and employer obligations, and a statement thatread..“In our previous email to you last week we advisedyou that we had applied for the Government Wage Subsidy on your behalf. We havebeen working through individual Government Subsidy detail with management atThe Ministry of Social Development (MSD) over the past week.” Idid not receive an email before that saying they had applied for my wagesubsidy.I did receive more emails after that around April 20th though, asking about mycurrent situation and availability to work and hygiene and new protocols thatare now in place for working during lockdown. It was not clear to me I was nolonger employed with Extrastaff at that point in time, these emails alsoindicated otherwise. As you can see I have tried to do the right thing given the extreme situationby asking for my holiday pay after I lost my job directly due to coronavirus onthe same day lockdown was announced. Because I did this, I can’t get a wagesubsidy that I have been told I otherwise would have got. It seems like I’vefallen through a loophole in the law maybe.. ? I’ve spent nearly all my savingsand now to know I may not get back paid for Jobseeker Support means I may haveto move out of my home. Hopefully you can offer me some advice around this situation, I feel stuck betweena rock and a hard place with people that keep pointing the finger at eachother. I don’t feel like Extrastaff have wronged me at all but rather that thesituation is a new and tricky one. The Government announced in the budget the creation of 11,000 new environmental jobs. When I look on the DoC career website there are zero jobs. Do any of the experts have any further information on where to find out more information?
Hi I have a casual staff member who did average of 20.5 hrs before lockdown and I received the subsidy for them. I have been paying 100% and now 80% with minimal cashflow. Now we are back at work I can only offer 5-10hours. Do I top up her hours to meet the 80% payment with the subsidy? Thanks
I work in the Beauty industry & have a pregnant staff who claims she cannot work till level 1 due to distancing. We have zero active cases in our region and I have had to turn away all of her clients until she can return, even when she returns, I cannot guarantee her clients will return. She has children who are heading back to school and is not staying home during level 2, isn’t that just as risky as coming to work? Any tips or info would help thank you
I have an employee that has informed me they can not work rostered shifts offered now we can reopen due to University course requirements. They are contracted to do a minimum of 10 hours per week. With a four week notice period.Have received the wage subsidy while we have been unable to trade the subsidy.Their education is their priority and mine is my business and its staff. I can not hold a position open for someone that can not work for me. How can I approach this?
Kia ora, I have a question about paying the wage sudsidy now we are on level 2. I have casual staff and have rostered them on but one is saying they are unavailable to work. Do they still get the wage sudsidy or do they get no pay as it is their choice they can not work that week?

We’re a travel operator with no revenue and currently the only source of income for my staff is the wage subsidy. I’m hopeful wage subsidy will be extended and optimistic about the long term future of the business when international borders reopen. In the short term what do I do with my staff when the wage subsidy ends- struggling to understand what “stand down on no pay means”, should I make my staff redundant, should my staff resign? If they resign will it impact their ability to claim income support. We don’t have a HR team – any help gratefully received – thank you.
Hi everyone, I have just spent the weeks of lockdown rebuilding my business (Day spa). I would like to introduce a banding system/wage structure for my staff to strive towards increase in hourly rate by achieving certain criteria and a level of standard. Does anyone have an idea where to start and what things to include besides increase monthly sales by a % or keeping rebooking of new clients at over 85%Thank you
