Can I use a non disclosure agreement to prevent a potential business partner using my idea

      Question submitted 21/07/21 @ 08:57am

Can I use a non disclosure agreement to prevent a potential business partner using my idea? I am in the early stages of a potential business venture and do not want the company to take this idea and start it without me.

        Hi Luke

A non-disclosure agreement is certainly a good start and highly recommended for disclosing confidential information to a prospective business partner. If the idea is for a product or process that might be patentable, you could consider seeking advice from your patent attorney regarding the possibility of filing a provisional patent application ahead of any confidential discussions. If the product or process is not yet sufficiently developed then this might not be an option, and you will just have to rely on the deterrent effect of the NDA.

        Good luck
        Simon
